This Privacy Policy describes how Empro ("Company," "we," "us," "our"), operating the GateSync platform ("Service"), collects, uses, stores, shares, and protects information obtained from and about users of the Service. This Policy applies to all individuals who interact with the Service, including community administrators, security personnel, residents, visitors, demo users, and trial users.

By accessing or using the Service in any capacity — including creating an account, accessing a demo, starting a trial, or being registered as a resident or contact by a community administrator — you acknowledge that you have read and understood this Privacy Policy and consent to the practices described herein.

This Privacy Policy is incorporated into and subject to our Terms and Conditions.

Important Notice: Community administrators who enroll residents and manage visitor data are responsible for ensuring they have obtained appropriate consent from residents before submitting their personal information (including phone numbers) to the Service. By submitting resident or visitor data, the community administrator represents and warrants that they have the legal authority and necessary consents to do so.

We may share aggregated, anonymized, or de-identified data with third parties for any purpose, including research, analytics, marketing, and industry benchmarking. This data cannot reasonably be used to identify any individual.

4. SMS Communications

4.1 Types of SMS Messages

The Service sends the following types of SMS messages to phone numbers registered within the system:

By using the Service or by having your phone number registered in the Service by your community administrator, you consent to receive SMS messages as described above. Community administrators are responsible for informing residents that their phone numbers will be used for SMS-based visitor management through GateSync and for obtaining appropriate consent before registering resident phone numbers.

4.3 Opting Out

You may opt out of receiving SMS messages by contacting your community administrator and requesting removal of your phone number from the system. You may also reply STOP to any SMS message received from the Service. Please note that opting out will prevent the Service from sending you visitor notifications and access approval requests, which may affect your ability to manage visitor access to your community. We are not responsible for any consequences resulting from your opt-out.

4.4 Message and Data Rates

Standard message and data rates from your mobile carrier may apply. We are not responsible for any charges incurred from SMS messages sent through the Service.

4.5 SMS Data Retention

SMS message logs (including message content, sender/recipient phone numbers, timestamps, and delivery status) are retained as part of gate activity records. See Section 6 for data retention details.

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect. These measures include:

However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information. You acknowledge that you provide information at your own risk, and we are not responsible for any unauthorized access, loss, or disclosure of your data that occurs despite our commercially reasonable security measures.

6. Data Retention

6.1 Active Accounts

We retain your information for as long as your account is active or as needed to provide the Service. Gate activity logs, visitor records, SMS logs, and allow-list data are retained for the duration of your subscription and for a reasonable period thereafter for our legitimate business purposes.

6.2 After Account Termination

Following account termination or expiration, we may retain your data for up to twelve (12) months for the following purposes: compliance with legal obligations, resolution of disputes, enforcement of our agreements, internal analytics (in anonymized form), and business continuity. After this retention period, we will delete or anonymize your data, except where a longer retention period is required or permitted by law.

6.3 Demo and Trial Data

Data from demo sessions may be purged automatically at regular intervals (typically daily). Data from trial accounts may be deleted within 14 days of trial expiration if a paid subscription is not activated. We are not obligated to retain or provide copies of demo or trial data.

6.4 Backup Copies

Residual copies of data may remain in backup systems for a limited period after deletion from primary systems. Backup data is subject to the same security protections as primary data.

8. Your Rights and Choices

8.1 Access and Correction

8.2 Data Deletion Requests

You may request deletion of your personal information by contacting us at privacy@empro.biz. We will process your request within 45 days, subject to any legal obligations that require us to retain certain data. Please note that deletion of your data may render the Service inoperable for your community, and we are not responsible for any consequences of data deletion requested by you.

8.3 Data Portability

Upon written request, we will provide you with a copy of your personal information in a commonly used, machine-readable format within 45 days. This right applies only to personal information you have provided directly to us.

8.4 Residents and Visitors

If you are a resident or visitor whose information has been entered into the Service by a community administrator, please direct any privacy inquiries or data requests to your community management office. We will cooperate with community administrators to fulfill valid data subject requests.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, our business purpose for collecting it, and the categories of third parties with whom we share it.

9.6 How to Exercise Your Rights

To exercise your California privacy rights, contact us at privacy@empro.biz with the subject line "California Privacy Request." We will verify your identity before processing your request and respond within 45 days.

We reserve the right to update or modify this Privacy Policy at any time, at our sole discretion. We will post the updated Privacy Policy on the Service with an updated "Last Updated" date. Changes are effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Privacy Policy.
